Terms of Service

These Terms of Service (“Terms”) govern your access to and use of wyodynamics.com and the related pages, materials, and contact forms we make available there (the “Site”). The Site is operated by WYODYNAMICS (“WYODYNAMICS,” “we,” “us,” or “our”), based in Cody, Wyoming. By using the Site, you agree to these Terms and to our Privacy page. If you do not agree, do not use the Site.

Please read these Terms. They are a contract between you and WYODYNAMICS. They cover what you may do on the Site, what we own, and the limits of our responsibility. If you do not agree, do not use the Site.

1. The Site

The Site describes our work in industrial biotech and physical systems, including the Algaloid Drive, and gives you a way to contact us. We may change, suspend, or remove any part of the Site at any time. We do not promise that the Site will always be available, uninterrupted, or free of errors.

You may use the Site only if you can form a binding contract and only in compliance with these Terms and applicable law. The Site is meant for a general audience and is not directed to children under 13.

2. Acceptable use

You may browse the Site and send us information through the forms we provide. You will not, and you will not help anyone else to:

  • break the law, infringe someone’s rights, or use the Site to deceive;
  • probe, scan, or test the vulnerability of the Site, or bypass any access control;
  • scrape, harvest, or copy the Site by automated means, except that public search engines may index public pages as allowed by our robots.txt;
  • interfere with the Site or with anyone else’s use of it;
  • send malware, spam, or unsolicited commercial messages through the Site;
  • copy, modify, or redistribute the Site or our materials except as these Terms allow; or
  • imply that we sponsor, endorse, or are affiliated with you without our written consent.

3. Intellectual property

The Site and its contents, including text, images, video, software, logos, and the selection and arrangement of those materials, are owned by WYODYNAMICS or our licensors. We reserve all rights that we do not expressly grant.

We grant you a limited, revocable, non-exclusive license to access and view the Site for your own information. That license does not include any right to use our names or marks except as described in our Trademark Policy.

If you send us ideas, suggestions, or other feedback, you agree that we may use them without restriction or payment to you.

4. Information you send us

If you contact us, including through a form on the Site, you are responsible for what you submit. You represent that you have the right to provide it and that it does not violate the law or anyone else’s rights. We may use what you send to respond to you, to consider a relationship with you, and as described in our Privacy page.

5. Third-party services

The Site may link to other sites and may use services we do not control, including a contact form hosted by Typeform and measurement tools such as Google Analytics. Those services have their own terms and privacy practices. A link is not an endorsement. Your use of a third-party service is at your own risk.

6. No professional advice

Materials on the Site are for general information. They are not engineering, scientific, investment, legal, or other professional advice, and they are not an offer to sell any product or to enter any partnership. Performance descriptions, including descriptions of systems and processes, may be illustrative. Actual results depend on conditions we do not control. Do not rely on the Site as the basis for a decision without your own review.

7. Disclaimers

The Site is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Site, or any information on it, is accurate, complete, current, or free of harmful components.

8. Limitation of liability

To the fullest extent permitted by law, WYODYNAMICS and its directors, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Site, whether in contract, tort, or otherwise, even if we have been advised of the possibility of those damages.

To the fullest extent permitted by law, our total liability for any claim arising out of the Site will not exceed one hundred U.S. dollars (US $100). Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

9. Indemnity

You will defend and indemnify WYODYNAMICS and its directors, officers, employees, and agents against any claim, loss, or expense (including reasonable attorneys’ fees) arising out of your use of the Site, your submissions, or your violation of these Terms or of anyone else’s rights.

10. Governing law

These Terms are governed by the laws of the State of Wyoming, without regard to conflict-of-law rules. You and we agree that the state and federal courts located in Wyoming are the exclusive venue for disputes arising out of these Terms or the Site, and you consent to personal jurisdiction there. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

11. Changes

We may update these Terms by posting a revised version on this page and changing the date above. The revised Terms apply from the time they are posted. If you continue to use the Site after that, you accept the revised Terms. If you do not agree to a change, stop using the Site.
